Weight Watchers Print and Digital Accessibility Settlement Agreement

Posted here is the settlement agreement between Weight Watchers, the American Council of the Blind, and blind Weight Watchers members Alice Ritchhart and Lillian Scaife. The agreement demonstrates Weight Watchers’ strong commitment to digital accessibility for its members and subscribers who are blind and visually impaired. Weight Watchers will be using the Web Content Accessibility Guidelines (WCAG) 2.0 Level AA as the standard for its online and mobile application content, and will be providing print material in accessible formats for persons with visual impairments who cannot read standard print. The agreement, reached using Structured Negotiations, also includes training, monitoring and implementation provisions. Linda Dardarian of the Oakland civil rights firm Goldstein, Borgen, Dardarian & Ho was co-counsel with the Law Office of Lainey Feingold in representing the blind community. Staples Point of Sale Press Release

The Staples Accessible Web Site and Point of Sale Settlement Agreement below was negotiated by Lainey Feingold and Linda Dardarian using Structured Negotiations on behalf of the American Council of the Blind (ACB), the American Foundation for the Blind, and the California Council of the Blind (CCB). In the Agreement, Staples agreed to install tactile point of sale devices in every Staples store in the United States and to upgrade its website to comply with the Web Content Accessibility Guidelines (WCAG) promulgated by the Web Accessibility Initiative (WAI) of the World Wide Web Consortium. Safeway Web Accessibility Settlement Agreement

This is the settlement agreement about the accessibility of Safeway’s online grocery delivery website. The company worked on this initiative in Structured Negotiations with individual customers with visual impairments in California and Washington State. The Safeway shoppers were represented by the Law Office of Lainey Feingold and Linda Dardarian of the Oakland, California civil rights firm. Safeway will be using the Web Content Accessibility Guidelines (WCAG) 2.0 Level AA as its web standard. When its grocery delivery site meets this standard, Safeway will remove a legacy separate site known as the “Access Site” that it had maintained. Bank of America has long been a leader in its commitment to accessible digital content. The agreement posted here concerns accessibility enhancements to the bank’s travel rewards redemption site. This agreement was reached through Structured Negotiations, a collaborative dispute resolution process. Since its early commitment to Talking ATMs and web accessibility in 2000, Bank of America has had a leadership role in providing accessible services to customers who are blind and visually impaired. Posted here is the Bank’s most recent settlement agreement with the blind community, addressing the accessibility of security features on the bank website and mobile iOS applications. Bank of America worked on this initiative in Structured Negotiations with the Bay State Council of the Blind and bank customers Carl Richardson of Massachusetts and Shen Kuan of California. Gratitude for a Poached Egg (an Accessibility and Negotiation Strategy)

Whenever I travel, I try to eat in local restaurants serving traditional foods. That’s how I found myself at 417 Union in Nashville last month eating poached eggs, grits and a biscuit. The eggs were perfect and I asked the waitress to thank the cook for me. She came back later and told me: “His day is going to go a lot better now that he knows he done good.” Her comment sums up my experience as a negotiator in the digital accessibility space. Web Accessibility for Grocers: Winn-Dixie Wasn’t Paying Attention

Last month the Winn-Dixie grocery chain lost the very first trial under the Americans with Disabilities Act about the accessibility of a private company’s website. A blind shopper had sued the chain when he couldn’t access online coupons and other parts of the company’s website. The judge’s verdict was big news; unlike most accessibility stories it was covered in the mainstream media. But web accessibility for grocery stores is nothing new. If Winn-Dixie had been paying attention, it would have known over three years ago that grocery chains were making their websites accessible.
